The Arena Limited at Christchurch (TAL) offers you and other members of the public the ability to participate in airsoft events or activities sponsored, hosted or organised by it, whether at its premises or another location (Airsoft Event).
IMPORTANT INFORMATION
This Agreement must be read, understood and signed by you before you will be permitted by TAL to participate in or observe an Airsoft Event. If you have any questions please ask us before signing this Agreement.
Your understanding of this Agreement will be tested by a TAL appointed referee or safety officer (Referee) before you are first permitted to participate in an Airsoft Event or at any other time a Referee considers appropriate.
Your participation in all Airsoft Events is at the sole and absolute discretion of any Referee and TAL.
HEALTH & SAFETY WARNING
TAL endeavours to provide a safe environment at all Airsoft Events. However, airsoft is a sport that has an element risk (including death, disability, physical injury or harm, and loss of or damage to personal property) (Harm or Damage) even when played in a safe environment. By signing this Agreement, you agree to waive your rights and release TAL, its employees and agents and the referees at any Airsoft Event from liability should Harm or Damage be sustained by yourself or your personal property at any Airsoft Event.
AGREEMENT
In consideration of TAL permitting you to participate in Airsoft Events, you agree as follow:
(a) You acknowledge that you participate in all Airsoft Events at your own risk. Such risks include, but are not limited to, Harm and Damage, as described above.
(b) You must attend and take part in a pre-game safety briefing before participating in an Airsoft Event.
(c) You will wear all safety gear which may be required by the Rules from time to time, in particular, a full face mask or other appropriate full face protection (which is acceptable to the Referees for the Airsoft Event) must be worn at all times.
(d) You will exercise reasonable caution, as appropriate to the terrain and environment, when moving around the Game Field and TAL’s premises.
(a) You must advise TAL of any pre-existing medical conditions that may impact on your ability to participate in any Airsoft Event or that may affect medical treatment.
(b) You consent to receive medical treatment in the event of an injury, accident, and/or illness during an Airsoft Event.
(a) We collect and hold the following Personal Information from you:
(i) Your name;
(ii) Your email address;
(iii) Your emergency third party contact person details:
(iv) Your mailing address; and
(v) Your age;
(b) Any of the Personal Information we collect from you will be collected and stored in our secure database for the purpose of communicating TAL’s informational updates and promotional material.
(a) You may be tested on the terms of this Agreement, the Rules and health and safety matters at any time by a Referee or an employee or agent of TAL. If any of those persons consider, in their sole and absolute discretion, that you do not display a sufficient understanding of any of these matters, you will be required to cease participating in the Airsoft Event.
(b) Your participation in any Airsoft Event is at the sole and absolute discretion of any Referee and TAL. If a Referee or TAL requires that you cease to participate at an Airsoft Event, you must immediately cease to do so and leave the field of play.
(c) If, for any reason, you are removed from the Game Field or from TAL’s premises, you are not entitled to a rebate of any fee paid to TAL whatsoever.
(d) Whilst TAL accepts fair wear and tear to airsoft equipment belonging to TAL, should any airsoft equipment owned by TAL be damaged whilst in your control, or on your person, you may be liable to pay $100 as a breakage fee (Breakage Fee)
(a) You waive, release and discharge TAL, its employees and agents and the Referees of any Airsoft Event from all liability to you resulting from any Harm or Damage caused to you or your equipment.
(b) You indemnify TAL for any and all costs (including costs incurred on a solicitor client basis), losses, damages, compensation or fines incurred by TAL, its employees or agents or the Referees of any Airsoft Event, as a result of your breaching the terms of this Agreement.
(c) You agree not to take legal proceedings against TAL, its employees or agents or the Referees of any Airsoft Event as a result of any events or circumstances, including any Harm or Damage to you or your equipment, arising out of any Airsoft Event.
(a) TAL for promotional, security and health and safety purposes; and (b) persons who have signed an Audio Visual Content Agreement with TAL. 10. Airsoft Gun Ownership:
(a) You understand that I must be over 18 years of age to legally own an airsoft gun, or 16 to 18 years old with a firearms licence to own an airsoft gun.
(b) If you are under 18 years of age, you must be supervised in the use of any airsoft gun and your supervisor is noted below.
(c) You acknowledge that TAL is unable to sell you an airsoft gun unless you are a member of the Club or another incorporated airsoft club. Proof of membership will be required by TAL prior to any sale.
(a) If you breach this Agreement, TAL may ban you from Airsoft Events and its premises.
(b) You acknowledge that this Agreement covers each and every Airsoft Event in which you participate.
(c) By signing this Agreement you confirm you have read and understood this Agreement and have asked any questions on areas which were unclear to you before signing.
(d) This Agreement is governed by the laws of New Zealand.
